My EZHealth, Inc., is committed to protecting your privacy. This Privacy Policy describes My EZHealth’s privacy practices in relation to your use of the My EZHealth™ website and technology (“the Service”), including any data that may be collected by My EZHealth through your My EZHealth account. Please read the following carefully to understand the Service and our practices regarding your information. By using our website and the Service, you consent to the handling of your information in accordance with this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Service. 

“We” “us” and “our” refer to My EZHealth, and “you” and “your” refers to you (the end user). We do not use or disclose your information except as described in this Privacy Policy.  This Privacy Policy is intended to be read alongside the My EZHealth Privacy Notice found here and My EZHealth Terms of Use found here.

 

Introduction

The Service is a personal health technology website platform from My EZHealth that lets you upload, edit, store, manage and share your personal health-related information. The Service is not a personal health record or PHR.  Rather, it is a place for you to upload or enter your health information from various sources (or create information yourself), and then store, manage, share, and use that information as you choose.

The Service may be used by you to assist you in assembling health information in a usable format. It is important for you to understand how the information that you submit, review and edit in the Service is used by us.

 

Not a Medical Service

The contents of the Service, such as text, graphics, images, personal health information, and other material contained in the Service, and all information and data produced by the Service from your input of that information (“Content”) are for informational purposes only.  The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. The information in your account may not be complete, accurate or up-to-date and should be viewed by any health care provider as informational only. 

If you allow others to access your account, you acknowledge that that person has full control over your account. The health information you upload onto or input into the My EZHealth website is not shared with any third party by us. This information is not reviewed by a physician, nurse, or other health care provider to make a diagnosis for your or for your treatment purposes.  Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.  You agree that the Service and the information and guidance provided by the Service do not constitute the practice of medicine or any medical, nursing, or other professional health care advice, diagnosis, or treatment.  Never disregard professional medical advice or delay in seeking it because of your use of the Service. 

 

Signing in to My EZHealth and Creating an Account

We do not authenticate you in order for you to use the Service. To create Your Service account, you must provide personal data such as first and last name, date of birth, e-mail address, gender, and zip code.  A Service account allows you to upload your health records that you have requested and received from your health care provider, as well as any other health information you choose to add.

 

Sharing health data

Except as stated below, no third party has access to your information through the Service unless you grant such access. You alone make the decision whether to share your information with others. Because inappropriate granting of access could allow someone to violate your privacy, you should be cautious about granting access to your data. We do not control or monitor the activities of any third party to whom you have granted access to your information.

 

Access and controls

You can review, edit or remove your personal information on the platform, or close your My EZHealth account, at any time.

 

Email communications

By providing us with your email address, you consent to us communicating with you via email. We will use the email address you provide to communicate with you as described below. You can opt-out of receiving such information by emailing us at support@myezhealth.com.

 

How we collect your information

We may collect and process the following Information about you:

(a) The following categories of information: (1) contact data (such as your e-mail address and phone number); (2) demographic data (such as your gender, your date of birth and your zip code); and (3) other identifying information that you voluntarily choose to provide to us, including without limitation unique identifiers such as passwords, and Information in emails or correspondence you send to us;

(b) Information that you provide by filling in forms on our platform, including information provided at the time of registering to use our platform, subscribing to the Service, posting material and information or requesting further services;

(c) Information you provide us, or that we may collect from you, when you report a problem with the Service;

(d) a record of correspondence if you contact us;

(e) general, aggregated, demographic and non-personal Information;

(f) details about your computer, including but not limited to your IP address, operating system and browser type, as well as information about your general internet usage, e.g., by using technology that stores information on or gains access to your device, such as cookies, tracking pixels, web beacons, etc., (together, “Cookies”), discussed further below;

(g) your email address from a third party if you indicate that you have consented to that third party sharing your Information with us; and

(h) any other Information we reasonably consider necessary to enhance your experience with the Service.

 

How we use and share your information and usage information

The Service uses your personal information and usage information to provide you the Service and to personalize your user experience. We and our suppliers may also use some of this information to improve our respective products and services, including the Service. We may use aggregated information from the Service to improve the quality of the Service and for marketing of the Service (for example, to tell potential advertisers how many Service users live in a particular region). This aggregated information is not associated with any individual account. Except as set forth in this Privacy Policy, we will not share your information in personally identifiable form with any other party without your consent, unless we are required to do so. 

We may collect information about your interaction with the Service. For example, we may use web site analytics tools to retrieve information from your browser, such as the site you came from, the search engine(s) and the keywords you used to find the Service, the pages you view within the Service. We also may use technologies, such as cookies (described below), to collect information about the pages you view, the links you click and other actions you take on the Service. Additionally, we may collect certain standard information that your browser sends to every web site you visit, such as your IP address, browser type and language, access times, and referring web site addresses. This information is referred to as “Usage Information.”

How we use your information

We may use Information held about you in the following ways and communicate with you via various channels, including without limitation emails, push notifications, and web notifications unless you opt-out of such communications:

(a) to provide you with information, feedback or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes;

(b) contacting you when necessary or requested to facilitate your use of the Service;

(c) notifying you about certain resources or services we think you may be interested in learning about;

(d) to improve the Service, enhance your experience of the platform, and deliver a better and more personalized service to you;

(e) to ensure that content from our platform is presented in the most effective manner for you and the device you use to access our platform;

(f) to notify you about changes to the Service; 

(g) to respond to subpoenas, court orders, legal process, governmental requests or as otherwise required by law; to prevent, report or investigate illegal activity; or to establish or exercise our legal rights or defend against legal claims; and

(h) in the event of a business transfer, such that our company or some or all of our assets are acquired, customer information will be one of the transferred assets. In such event, we will require such successor business entity to provide at least the same level of protection for your personal information as described in this Privacy Policy. 

Note that our platform may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data or other information to these websites. 

How your information is stored

The Service stores or “caches” your information as necessary to provide you the Service.

All of the information you enter, edit, delete or view in the Service is added to your account once you click on “Save” or another similar button.

When you click the “Save” button, the cache of information used by the Service is also updated with the new information you added or changed. When you select that link, the Service updates all the information in the cache with the most current information.

Your information is retained by us indefinitely unless you close your account and request that the information be deleted.  We have no obligation to maintain your information for any period of time after your account is closed.

HIPAA

My EZHealth is not a HIPAA Covered Entity nor a HIPAA Business Associate of a Covered Entity.  My EZHealth is not a HIPAA Covered Entity.  Nor are we a HIPAA Business Associate because we do not provide the Service to you on behalf of a Covered Entity, such as your doctor. The Service does not hold records for healthcare providers or for other medical or case management purposes.  Therefore, HIPAA does not apply to My EZHealth. However, we are committed to maintaining your privacy using all of the measures described in this Privacy Policy and in compliance with any applicable law.

Security

My EZHealth maintains your information in a password-protected environment as a security measure to protect your data. Any data that you enter into the Service is stored in a secure hosted environment.  My EZHealth does not access the information that is stored in the secure hosted environment and it is not accessible by third parties without your providing such third party your login credentials.  

Your data is protected by an encrypted set of credentials. The data is only accessible by you, or other users with whom you have chosen to share your information.  You understand and agree, however, that no method of transmission over the internet, or method of electronic storage is completely secure and reliable, and we cannot guarantee its absolute security.

My EZHealth encourages you to take precautionary measures in maintaining the integrity of your data, such as controlling who has access to your account credentials.  We are not responsible for your handling or sharing of information on your account nor for any harm or other consequences from your sharing of information or a third party’s use or reliance upon your information.

Children’s Privacy Protection

The Service is not designed for, or intentionally targeted at, children 13 years of age or younger. It is not our policy to intentionally collect or maintain information about anyone under the age of 13. No one under the age of 13 should directly submit any information to the website nor should you enter the information of anyone under the age of 13 onto the platform. If you are under the age of 13, please do not use the Service.

Third Party Links

The Service may contain links to web sites operated by third parties. We have no control over the privacy policies or practices of such third party sites and we are not responsible for the privacy practices or the content of such websites. You should review the privacy policies and terms of use of those sites for more information about the policies applicable to those sites before your access their website. 

How We Use Cookies

We use cookies with the Service to enable you to sign in and to help personalize the Service for you. A cookie is a small text file that a web page server places on your hard disk. We may update this Privacy Policy from time to time. When we do, we will revise the “last updated” date at the top of the Privacy Policy. Your continued use of the Service constitutes your agreement and consent to this Privacy Policy and any updates.
